The Trial of Dr. Chua
Chua, 45, has been held in the Camden County jail since September 2006 when he was arrested and charged with the drug overdose death of Jamie Carter III. Prosecutors say Carter, 20, died from drugs Chua prescribed for no legitimate medical purpose.

Chua guilty of felony murder and seven drug charges

After nearly 11 hours of deliberations, a five woman, seven man jury found Noel Chua guilty of felony murder and seven of the 16 drug charges for violating Georgia's Controlled Substance Act.

Prior the clerk of court reading the verdict, Judge Williams told the audience she would allow no outbursts or they would be arrested.

After the verdict was read, Williams asked each juror answered individually that his or her verdict was freely and voluntarily given. Each juror answered yes to the question.

Chua sat erect and displayed no emotion as the guilty verdicts were read, but supporters of the doctor in the audience slumped as the guilty verdicts were read.

No, a doctor who maintained an inappropriate relationship with a patient...who failed to properly monitor, and control, the powerful prescriptions he wrote that patient...who shared his home with that same patient, 20-some odd years his junior...who waited an hour to dial 911 after finding his patient dead in his own home...just went down the drain.

This wasn't "pain management". At best, it was negligence. At worst, murder.

If that's your idea of a doctor, you can have him.

I know someone on the jury, and they are dumber than dirt. I couldn't imagine putting my life in her hands. I feel for Chua. Can this be appealed?

As said before: The doctor will be known as a possible homosexual, confirmed as a doctor who did not treat a patient properly and who will never walk the green grasses of this earth again. Jamie too will be known as a possible homosexual and is now confirmed he was a drug addict. So many people will see the bad in both and not the good. I am sure they both did a lot of good to and for people also. Very sad ending for both.

I don't understand how the guilty verdict was arrived at. The jury must believe, beyond a shadow of a doubt, that Dr. Chua prescribed those meds with no medical reason. There was testimony that said that methadone was prescribed sometimes for pain. All of the other drugs except the methadone have been prescribed from other doctors. What am I missing?

Yes he is guilty! The jury has spoken, picked by Dr. Chua himself with the help of Bill Smith. Life in Prison plus 20 years will be a fair sentence for Mr Chua. He should have taken that plea agreement that Sheriff Smith told him not to take. He needs to go straight to the real prison and out of the hotel room provided by Sheriff Smith.

Justice for Jamie! I was worried that the jury might miss some of the legal points in this case, but came through. Thank you, each and every member of the jury.

The guilty verdict had nothing to do with Chua being gay, as some have speculated. Listen - he took Jamie home just 6 hours before his death because he had overdosed! Chua is a medical doctor! If he was such a great doctor as some of you claim, he would have hospitalized Jamie instead of leaving him alone to "sleep it off". Did some of you not read that? Chua left him to die! He knew he would die if left alone. Don't you all realize that? He put him in his bed before he left. He saw the drugs - and may even have administered the fatal dose!

Prison is full of "nice" guys who did bad things. And that's where Chua belongs.

Thank God for a jury who had the courage to do the right thing.

I would bet big bucks Sheriff Smith wishes he never hear of Chua and Chua wishes he never hear of Smith. One down one to go. I bet Smith's duck hunt is not so good. I bet money right now Smith couldn't hit a rubber ducky in a kiddie pool. Chua wanted a trial and he got one. Innocent until prove guilty. We may be Hooterville by the Sea but 12 os got it right. To those suffering pain, find a reputable doctor. My husband is on a narcotic for peripheral neuropathy - has been on it for years, and he has to go in for blood work every month, and he gets a new prescription every month. There are answers and treatment for pain. If one doesn't work for you, let your doctor use appropriate procedures for changing your meds, and don't try to treat yourself. That's where you get into trouble.

Jamie's epitat now reads thanks to what the prossecution needed to get a conviction: "Gay out of control drug addict."

That's what the DA needed and that's what the parents and family and so called friends will always now have to remember him by.

Dr. Chua had problems but none that warrant felony murder.

DA Kelley needed a conviction or else his head would roll. His story to the jury as he performed in his closing argument was sick, viscous, twisted, vile, non factual to the case, not based on evidence or common sense. And the jury bought his desperate and wreckless show. Any family that this lie was told to would be devastated as the Carter family has been and their reactions this past year are completely justifiable.

But,now there is no excuse for the Carter family attitude and actions this past year. They were always greedy and always wanted more.

I have never seen two more dispicable people that DA Kelley and ADA Jackie Johnson. I thought for sure that the jury would see right through them as the rest of us did.

Throughout this trial I found a great appreciation for Jamie Carter. I finally understood the excruciating pain he was in, mental and physical, that he coped with most all his life. He was not the “gay” out of control drug addict that the prosecution needed/used him to be to win their case.

But I was wrong, his family and DA and all his friends knew alot more than I did. Jamie will always be known by what his family, DA, ADA, State of Georgia and jury have written forever on his tombstone. "Gay out of Control Drug Addict!"

Doctors are already jumping ship and leaving this county. Fact.

Those remaining with real pain health issues are already feeling the *pardon the pun* PAIN and are being referred to SAVANNAH.

This trial had nothing to do with "professional Doctors". Those that do not cross that patient/DR. line are now intimidated about even discussing pain management .. even if it has been monitored & continued management. The handling of this case has ruined and intimidated them right out of town.... and we didn't have much to choose from as it was.

Being a Doctor in this community is one thing. Being a doctor that is having sex with his patient and providing controlled substance to his "patient"/lover is unlawful. The jury has spoken!!

Dr. Chua's other victims did not appear at trial to testify on behalf of Chua - they were there to make sure he never hurt another young man.

I tried. Because Chua was my doctor and I was on methadone(1 pill twice a day for over a year) Doctors in this town treated me like dirt. I didn't care if I stayed on methadone. If they wanted to put me on something else that was fine. I have been off methadone now for 8 months. I have to take 6 Ultram a day to be able to live my life. I had to go to a different town to find any help. But before Dr. Chua helped me I couldn't get out of bed. Thank you Dr. Chua in my eyes you will always be the doctor that saved me. If you don't like Dr. Chua I really could care less.

I'm so sorry to hear about your pain, and about losing a doctor who was trying to help you. But there are good, really expert doctors who can and will take your case. You may have to go to Jacksonville to find one, but get in to see a neurologist. They will evaluate your problem and have access to the lastest and best info on pain management.

You do understand that people sometimes have to take painkillers to stop the terrible pain they are suffering from? That they are not seeking drugs to get high. I think Jamie was in alot of pain, yes sometimes people start liking the way they feel on the drugs and take them even if they don't have pain.

You cannot prey on a 19-20yo man sexually. The family, friends of Jamie Carter have been spewing hatred and false claims from the beginning.
It's very hard to have sympathy for any of them as by the way they have behaved for the past year. They fester off each other with their own lies and propaganda.

Now they still don't want to be civil. The family or friends have never shown one ounce of compassion. They will always be victims of themselves.

I saw Jamie's dad on the FOX news after the game. He appeared so happy he forgot himself how that would appear.

Why else would they sacrifice the character of their son. They used Jamie in what ever they needed him to be at the time.
Last Fall he was a clean cut all american rah-rah type. Less than a year later they made him a gay out of control drug addict.

Jamie's character has Never been in question, the character of his parents and family has always been in question.

I guess people will be watching their character for a very, very long time to come. It stinks of MONEY!!

This is such a sad story for those on both sides. Unfortunately, the law is the law. So many doctors often try to treat outside their expertise. Chua should have referred Carter to a neurologist for his headaches. As a chronic headache sufferer myself, a neurologist has made the quality of my life so much better. I have never taken narcotic medications, because I have always refused to take them and they tend to cause rebound headaches. I now am on preventative medications and pain control medications that are non-narcotic for the times I do get a headache anyway. I am over forty and have suffered headaches for more than 30 years. Doctors need to realize that they really need to practice in their area of expertise and refer patients to specialists for their best care.

Very well put, Anonymous. This was bad, bad medical treatment that a doctor of Chua's so-called good reputation should not have done.

That's not how doctors treat a chronic problem like migraines. Chua indeed should have referred Carter to a specialist, like a neurologist, in the face of what appeared to be a problem beyond his expertise. It is clear, looking at the total picture, that
Chua quite likely exercised egregiously bad judgment in his reckless use of strong narcotics.

I just feel he was unduly influenced by the fact that he and Carter were living together, possibly as lovers, and to do what Chua did was a big NO-NO.

In retrospect, Chua should have accepted that plea offered by the DA. Well, he was haughty enough to think he could win his case. But, in the end, he could not escape the facts, and the jury did not buy what I thought was a wobbly defense.

It's more than aparent that those who said this conviction was based on evidence were not at the trial all week. What the DA said in his opening and closing statements were the key to the jury's decision.
I will say once again none of you so called Jamie supporters have not caught on to this in over a year. The character of Jamie (not his drug or sexual preference problems) has NEVER been in question.
The character of his parents and family is the "character" that has always been and will be forever, in question. They used and abused him.
So please, start respecting Jamie. He died nearly two years ago and you still demean him after all this time. Please start putting blame where it belongs and not on a dead man. It was not his fault he was in terrible pain.
It is his family that "chose" to use his death to their own advantage as coached by DA Stephen Kelley. I can't put it any nicer.

Justice was served and yes it is my opinion that Jamie is happy and smiling down on the verdict. His story needed to be told and the questions of his death needed to be answered and they have been.

Aparently you have not been following this case for the past year. Jamie's family continually made him what they needed him to be at the time. These past few months the needed him to be an out of control drug addict and gay on top of it. Last fall he was a clean-cut all american kid that never even touched drugs.

Dr. Noel Chua is not a doctor who stepped over any line and had a sexual affair with a patient. He was mentoring a drug addict who had been kicked out of his home and that of his grandparents earlier and had no place to go. He had worked in Dr. Chua's office and was abandoned by his family.
Dr. Chua was trying to help him. Instead of being honored, the DA, ADA and biased judge saw an opportunity for political points and saw a witch hunt and public lynching as their way to be seen as 'defenders of the public good.' They are cheap opportunists that should be driven from public office.

Leave the Carter family alone. To those that are saying such ugly things about Jamie's family.. You should be ashamed! Just think of it this way... if you have a son (s)yours could have been the next one for Chua. And don't say that you would have NEVERED let that happen to your child. Because the fact is noone can say Never. Plus, I am so proud of Jamie's parents that they went all the way with this. That shows what caring parents they are. If that would have been one of my children, I only pray that I would have the strength to follow through to see justice done. How easy it would have been for them to walk away and try to deal with the pain daily for the rest of their life. Only to hear on the news one day or read in a paper that another young man is dead at the hands of Dr. Chua.....
AS for the people on the jury... I just want you to know that I pray for each of you daily. I can only say that each of you did a very brave thing. You came back with the correct word.."Guilty". Each of you were not at all selfish you really cared about what you were doing. You took time and thought about all the information that was put before you. Thank you for last week.
